Welcome to SafePet! These Terms of Service (“Terms”) govern your use of the SafePet mobile application and website (collectively, “the Service”) operated by EvoSolve Solutions (“we,” “our,” or “us”).

By accessing or using SafePet, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

SafePet is an AI-powered application that:

• Analyzes photos of your pet's teeth and gums
• Provides dental health scores and assessments
• Generates personalized 30-day care plans
• Tracks dental health progress over time

2. Account Registration

2.1 Eligibility

You must be at least 16 years old to use SafePet. By registering, you represent that you meet this requirement.

2.2 Account Security

You are responsible for:

• Maintaining confidentiality of your login credentials
• All activities under your account
• Notifying us immediately of unauthorized access

2.3 Account Information

You agree to provide accurate, current, and complete information. We may suspend accounts with false information.

3. Subscription and Payments

3.1 Free Tier

• 2 free dental scans
• Basic health score
• 1 pet profile

3.2 Premium Subscription

• Monthly: $5.99/month
• Annual: $39.99/year (save 45%)
• 7-day free trial available

3.3 Payment Terms

• Payments processed via Stripe
• Subscriptions auto-renew unless cancelled
• Prices may change with 30 days notice
• No refunds for partial subscription periods

3.4 Cancellation

• Cancel anytime via app settings or Stripe portal
• Access continues until end of billing period
• No refunds for unused time

4. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Upload content that is not related to pet dental health
• Attempt to reverse-engineer our AI systems
• Interfere with or disrupt the Service
• Create multiple accounts to abuse free scans
• Share or resell access to your account
• Upload malicious content or viruses

5. Intellectual Property

5.1 Our Content

SafePet and its contents, features, and functionality are owned by EvoSolve Solutions and protected by copyright, trademark, and other laws.

5.2 Your Content

You retain ownership of photos and data you upload. By uploading content, you grant us a license to use it for:

• Providing the Service
• Improving our systems
• Marketing (only with explicit consent)

5.3 AI-Generated Content

Reports and care plans generated by our AI are provided as-is. You may use them for personal, non-commercial purposes.

6. Disclaimers

6.1 Service “As Is”

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.2 AI Accuracy

• AI analysis is probabilistic and may contain errors
• Results should not replace professional veterinary diagnosis
• We do not guarantee accuracy of dental assessments

6.3 Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not liable for any harm to your pet resulting from reliance on our Service

8. Indemnification

You agree to indemnify and hold harmless EvoSolve Solutions, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

9. Modifications to Service

We reserve the right to:

• Modify or discontinue features without notice
• Update these Terms at any time
• Change pricing with 30 days notice

Continued use after changes constitutes acceptance.

10. Termination

We may terminate or suspend your account immediately, without notice, for:

• Breach of these Terms
• Suspected fraudulent activity
• Upon your request

Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms shall be governed by the laws of Poland/European Union, without regard to conflict of law provisions.

12.2 Arbitration

Any disputes shall be resolved through binding arbitration, except for claims that may be brought in small claims court.
